Karine Jean-Pierre: It Was ‘Unconstitutional’ For SCOTUS To Overturn Roe V. Wade

On Wednesday, White House Press Secretary Karine Jean-Pierre claimed that the Supreme Court’s decision to overturn Roe v. Wade was an “unconstitutional action.”

“There has been an urgency from this president from day one, when the Supreme Court made this extreme decision to take away a constitutional right, it was an unconstitutional action by them,” Jean-Pierre said during a White House press briefing.

Roe created “a right that was around for almost 50 years, a right that women had to make a decision on their bodies and how they want to start their families,” she added.

Many Twitter users were quick to point out that it was not, in fact, unconstitutional for the Supreme Court to overturn Roe.

“Tell me you don’t understand what the Supreme Court does without saying you don’t understand what the Supreme Court does…” comedian Tim Young responded.

“Is there no one in this entire administration who knows how government works?” tweeted columnist Derek Hunter.

In June, the Supreme Court overturned Roe v. Wade in a 6-3 decision in Dobbs v. Jackson Women’s Health Organization, a challenge to a Mississippi law that bans abortions after the 15th week of pregnancy unless there is a medical emergency or a “severe fetal abnormality.”

“We hold that Roe and Casey must be overruled. The Constitution makes no reference to abortion, and no such right is implicitly protected by any constitutional provision, including the one on which the defenders of Roe and Casey now chiefly rely—the Due Process Clause of the Fourteenth Amendment,” Justice Alito wrote in his majority opinion.

Roe was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences. And far from bringing about a national settlement of the abortion issue, Roe and Casey have enflamed debate and deepened division,” Alito wrote. “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”
